TERMS AND CONDITIONS OF USE FOR DOGS ETC.
PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE PURCHASING, ACCESSING OR USING ANY OF OUR PROGRAMS, PRODUCTS AND SERVICES.
Terms of Use: All our programs, products and services are owned by Cindy Scott and Dogs Etc. All materials are copyrighted and can not be reproduced with out express consent and approval.
These terms of use govern your use of our website. By accessing and visiting this site, you acknowledge, agree, and accept these terms and conditions of use. Please read them carefully and regularly. If you disagree with these terms and conditions, you may not use our website. These terms of use are subject to change at any time in our discretion. Your use of this site after such changes are implemented constitutes you acknowledge, agree, and accept the changes.
Use and Consent
By purchasing or using any of our Programs, Products or Services, you agree to abide by these Terms of Use as well as our Disclaimer, Terms and Conditions and Privacy Policy, and any other terms and conditions that may apply, and are you are required to act in accordance with them. Accessing, purchasing, or using our Programs, Products, Services or Program Materials, in any manner constitutes use of the Program, Products, Services and Program Materials, and your agreement to be bound by these Terms of Use.
Dog owner (client) hereby accept and assume, without reservation, all risks associated with participation in the Online Courses/Classes/Private training sessions, including, but not limited to: the risks of any and all injuries to self, dog and any of family members or third parties who may attend; the risks that dog may cause injury to other persons and/or dogs involved in the Online Courses/Classes/Private training sessions; and the risks that saliva, water, food, snow and/or other debris may be present in the training area. Client has heard or read (and understand) any and all DOGS ETC.’s policies, and agree to abide by them to the extent applicable
Cindy Scott dba DOGS ETC. make no representations, guarantees, promises, implied or expressed, that any training received from Cindy Scott dba DOGS ETC. will cure a dog of any dangerous propensities. It is fully understood that regardless of the training received by the animal, any dog is always capable of biting. Client hereby agree to indemnify and hold harmless Cindy Scott dba DOGS ETC. from any and all claims, or claims by any member of my family or any other person while on the grounds of any facility where training takes place, the surrounding area thereto, on my own property, or in a public area as a result of any action by any dog, including client’s own.
Liability: If dog causes property damage, or bites or injures any dog, animal or person (including but not limited to Trainer and Trainer’s agents), during or after the term of this Agreement, then Client agrees to pay all resulting losses and damages suffered or incurred, and to defend and indemnify Cindy Scott and Dogs Etc.’s agents from any resulting claims, demands, lawsuits, losses, costs or expenses, including attorney fees. If dog is injured in a fight or in any other manner during or after the term of the Agreement, Client assumes the risk and agrees that Dogs Etc. should not be held responsible for any resulting injuries, losses, damages, costs or expenses.
At Dogs Etc.’s sole election, Dogs Etc.’s duties hereunder shall terminate if (a) in Dogs Etc’s sole judgment dog is dangerous or vicious to Trainer or any other person or animal, or interferes with the training of other dogs, or (b) Client breaches any term or condition of this Agreement. Upon termination in accordance with the foregoing, Dogs Etc.’s duties shall terminate but all other provisions of this Agreement shall continue in full force and effect.
This Agreement is binding upon client, spouse of client, and children of client. This Agreement supersedes all prior discussions, representations, warranties and agreements of the parties, and expresses the entire agreement between client and Dogs Etc. regarding the matters described above. The parties confirm that, except for that which is specifically written in this Agreement, no promises, representations or oral understandings have been made with regard to dog or anything else. Without limiting the generality of the foregoing, client acknowledges that Dogs Etc. has not represented, promised, guaranteed or warranted that dog will never bite, that dog will not be dangerous or vicious in the future, that dog will not exhibit other behavioral problems, or that the results of the training will last for any particular amount of time. This Agreement may be amended only by a written instrument signed by both client and Dogs Etc..
Guarantee-All training programs come with lifetime support. Because we truly care about you and your dog, we are here to help any situation that may ever arise. Because commitment and consistency are crucial to the success of your training, our refund policy is that only credit will be issued after training has begun.
